One thing that’s always stuck with me is the scene from “Ant Man” when Scott is working at Baskin-Robbins after being released from prison and then is fired once the company finds out about his criminal history. While “Baskin-Robbins always finds out” is a great line, the whole situation is one that many convicted criminals will find all too familiar.

In America, our criminal justice system is more concerned with punishment than rehabilitation. That means people who have committed crimes and gone to jail for them have an extremely hard time succeeding once they’re released. Prison is supposed to be a place that you only ever go once, but most of America’s criminals find themselves as prisoners multiple times. This is called recidivism: the tendency of a convicted criminal to return to jail after being released. America has the highest rate of incarceration in the world, making our criminal justice system one that is increasingly being scrutinized. The privatization of prisons contributes to this. So, what does all this mean for the people who are in and out of jail?

Well, for one, all of these statistics that point to the American criminal justice system neglecting rehabilitation means bad news for someone who is convicted of a crime. If you’re convicted and go to jail for what you did, you’ll likely go back to jail at some point, or at least be arrested again. You will also continue to be punished once you return to society because you’ll have a record that could prevent you from finding a good job or a good living situation.

Additionally, most people who are incarcerated in the United States are guilty of possession or trafficking of illegal drugs. Many of them have addictions, and many of them continue to do drugs while they’re in prison. Those prison sentences can be long, too. Even simple possession of a drug like cocaine can land the possessor in prison for years. It doesn’t always seem fair. Good criminal defense lawyers feel that same way.

A criminal defense lawyer may handle all sorts of cases, including DUIs, theft, drug crimes, assault, and white-collar crimes like tax fraud. Their job is to help their clients avoid maximum sentencing, or to prove their innocence. After all, the assumption is that everyone is innocent until proven guilty, and in some cases, people really can be convicted for crimes they had nothing to do with.
